| Preparation
for Mediation Mediation+ is not a passive process. It requires the active preparation and participation of all involved to be successful. The most productive and cost-effective mediations generally occur when all parties and their representatives do their “homework” in advance. We encourage all participants to spend the necessary time to properly prepare for mediation. Most important, lawyers (or other representatives) should talk with their clients well in advance to resolve as many issues as possible that may be impediments to resolution. This will make the mediation session more productive and cost-effective for everyone. If settlement authority is needed from a person who will not be in attendance, then this should obviously be obtained in advance whenever possible. All materials you may wish to use should also be brought with you. This saves time during the mediation. If issues arise concerning preparation, you are encouraged to discuss these in advance with the mediator. |
